The United States Citizenship and Immigration Services (USCIS) has announced significant fee increases for a wide range of immigration forms and services that will go into effect on April 1, 2024. However, USCIS is also implementing automatic fee waivers (not charging) for certain forms related to U nonimmigrant status for victims of crime, T nonimmigrant status for victims of human trafficking, and forms associated with the Violence Against Women Act (“VAWA”).
USCIS has stated the increases aim to account for operating costs like staffing and technology modernization. On the other hand, USCIS has stated the applications with no fee remove financial barriers for victims of crimes like domestic violence, sexual assault, and human trafficking who apply for legal immigration status through the U and T visa programs, as well as those applying through forms relating to the VAWA.
For more information regarding which forms are impacted and the new fee schedule can be found on the USCIS website.
Applicants are advised to file forms subject to increases before April 1, 2024, if possible, to avoid higher fees. Those eligible for U or T visas can take advantage of the new fee exemptions after that date.
